The opposition criticizes that for almost a year and three quarters, Parliament has not been able to choose the candidates for a vacant one place of the judge of the Constitutional Court (ÚS) SR. According to opposition parties, the coalition approach is to examples that the government is not about the functionality of the state, but only to maintain power. It also points to the inability and indifference of the government on this issue. The chairman of the ÚS Ivan Fiačan is considering asking for a speech in Parliament with an appeal for the election of candidates.
“The Constitutional Court is not worth the coalition for minimal attention. Robert Fico (Smer-SD) was only interested in the Constitutional Court when, according to publicly known information, it wanted to become its chairman,” said Lucia Plaváková, Member of the National Council (NR) of the Slovak Republic for PS. She recalled that the US was overwhelmed by hundreds of cases from state authorities and ordinary people. “Since 2021, on average, 215 proposals have come to the Constitutional Court a year. One missing judge for court means that it can handle up to 300 extra more.
SaS claims that the free place of the constitutional judge is just about completing the necessary political trade. “The fact that the Constitutional Court has been incomplete for almost two years is indifferent to this coalition. The opposition does not have the necessary power in Parliament to be elected by the candidate,” Mária Kolíková (SaS) told TASR.
According to the movement, Slovakia is to some extent this government’s inaction and sabotage, as the Constitutional Court is exposed to malfunction. “The dysfunction of the court most affects people who cannot get justice, because the Constitutional Court is overloaded and handles things slower,” said Milan Vetrák from Slovakia.
According to the Movement, Slovakia cannot be a problem for the coalition properly and in time to choose a candidate for the judge of the US. “However, it cannot be ruled out that the election of a candidate for a constitutional judge is prolonged by the current government coalition deliberately because it retains this place as a lucrative political trial for buying, whether for rebellious parliamentarians or public officials from whom they expect to resign prematurely.”
According to the KDH, the coalition fails as it does not fulfill its constitutional obligation. She considers this as a business card of her priorities and values. “The government coalition pays more attention to investigators, police or prosecutors. It is a business card of respect for the Constitution and the constitutional duties of constitutional officials, including the government and deputies of the coalition,” the Christian Democrats said, saying that the opposition does not have the necessary majority to influence the election of the constitutional judge.
Fiačan re -points out the need to supplement the court by 13th judge who has been missing for a year and seven months. He thinks it is in the highest interest of the country. He is considering asking for a speech in Parliament as he did in 2019. The situation is causing a weakened proper functioning of the US. The average length of action before the US is prolonged due to the high number of things and the missing judge.
The place of the judge of the ÚS was released in September 2023, when Jana Laššáková resigned. By default, Parliament chooses twice the necessary number, so it has a pair of candidates. One of them is chosen by the President of the Slovak Republic and appoints him as a constitutional judge. The National Council of the Slovak Republic repeatedly did not choose any candidate, last unsuccessfully voted in March. A new choice is to be declared.
