According to the State Audit Committee today, in the legal protection procedure in the award of the public procurement for works on the sections of the Domžale-Šentjakob and Šentjakob-Ljubljana (Zadobrova) and the Ljubljana Šentjakob and Ljubljana LJUBLJANSKA, which is carried out by DARS, he granted a request for review submitted by Mapri Proasfalt.
She found that the successful tenderer – the company CGP and Pomgrad – did not enter the price of a purchase with a negative sign, as required by the contracting authority in one of the items of the tender pro forma invoice. Radiation of the negative sign of the purchase can be considered a clear mistake that the contracting authority can overlook in accordance with the Public Procurement Act. Due to this obvious error, the tender invoice is a computational defect that can be eliminated in accordance with the provisions of the law, the Audit Committee explained.
However, since Dars submitted the contract to the selected tenderer without eliminating the computational errors in the bid estimate of the selected, he acted in contravention of the provisions of the law, according to the Audit Committee.
The State Audit Committee therefore granted the request for review and annulled the decision on the award of the contract.
Three bids have been submitted to the public contract for the expansion of the Styrian motorway indentation to Ljubljana. The lowest was submitted by CGP and Pomgrad in the total performance, in the amount of EUR 80.79 million excluding tax (or EUR 98.6 million with tax). Mapri Proasfalt has submitted an offer worth EUR 84.5 million, and the Gorenjska construction company worth EUR 99.86 million without tax.
Mapri Proasfalt warned in a complaint that the value of the tender of the successful tenderer had fallen by around 2,700 euros from the tender to the selection. He accused Dars of incorrectly addressing the bidder’s defect in the pro forma invoice and counting it as a computational error.
Dars rejected the request for review, stating that the successful tenderer had made a computational defect, since in the waste material item, the negative sign provided by the system was noted, so a proper mathematical operation was not performed.
In doing so, he pointed to the provision of the Public Procurement Act, according to which, with the consent of the tenderer, the tender may be corrected due to the computational error, without changing the quantity and price per unit without VAT. He also pointed out that the correction represents an extremely small or insignificant share of the value of the offer.
